Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Refuge House Service Apps ("Services") provided by Refuge House, Inc. ("we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Service Description

Refuge House Service Apps are internal tools designed exclusively for authorized staff members of Refuge House, Inc. These applications facilitate foster care case management, including compliance tracking, home visit documentation, administrative workflows, and child welfare safety protocols in accordance with Trust-Based Relational Intervention (TBRI) care practices.

User Eligibility

Access to the Services is strictly limited to:

  • Current employees and authorized staff members of Refuge House, Inc.
  • Individuals who have been explicitly granted access by Refuge House, Inc. management
  • Users who have completed all required training and onboarding procedures
  • Individuals over the age of 18

Unauthorized access or use of the Services is strictly prohibited and may result in legal action.

Acceptable Use Policy

When using our Services, you agree to:

  • Use the Services only for their intended business purposes
  • Maintain the confidentiality and security of your login credentials
  • Protect the privacy and confidentiality of all children and families served
  • Comply with all applicable federal, state, and local laws regarding child welfare and data protection
  • Follow HIPAA regulations and organizational policies regarding sensitive information
  • Report any security breaches or unauthorized access immediately
  • Maintain accurate and truthful documentation in all case records

You agree NOT to:

  • Share your account credentials with unauthorized individuals
  • Access data or records outside your authorized scope
  • Attempt to bypass security measures or access controls
  • Use the Services for any unlawful or unauthorized purpose
  • Interfere with or disrupt the Services or servers
  • Upload malicious code, viruses, or other harmful content
  • Extract or harvest data for unauthorized purposes

Confidentiality and Data Protection

As a user of these Services, you acknowledge that you will have access to highly sensitive and confidential information regarding children in foster care, their families, and related case details. You agree to maintain the strictest confidentiality regarding all information accessed through the Services and to use such information solely for authorized foster care service purposes. Unauthorized disclosure of confidential information is grounds for immediate termination and may result in legal action.

Account Management and Termination

We reserve the right to:

  • Suspend or terminate your account at any time for violation of these Terms
  • Modify or discontinue the Services (or any part thereof) with or without notice
  • Refuse service to anyone for any reason at any time
  • Remove or disable access to any content that violates these Terms

Upon termination of your employment or authorization with Refuge House, Inc., your access to the Services will be immediately revoked. You must cease all use of the Services and return any organization-provided devices or materials.

Intellectual Property

The Services, including all software, content, and materials, are owned by Refuge House, Inc. and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services solely for authorized business purposes. You may not copy, modify, distribute, sell, or lease any part of our Services without explicit written permission.

Limitations of Liability

To the fullest extent permitted by law, Refuge House, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of (or inability to access or use) the Services.

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Indemnification

You agree to indemnify, defend, and hold harmless Refuge House, Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Dallas County, Texas, and you hereby consent to personal jurisdiction and venue therein.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitute your acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
